These terms govern the use of aricasurf.com and the contracting of services from Arica Surf Experience (surf lessons, stand-up paddle, drone footage, and transport) in Arica, Chile. By using this website or booking a service, you accept these conditions.
Acceptance and capacity
By contacting us and booking, you confirm that you have read these terms and that you have legal capacity to contract. If you book for a minor, you accept these terms on their behalf and assume the obligations of a parent, legal representative, or guardian, including the prior authorization described below.
About this website
This website provides information about our services, team, coach, and sea conditions in Arica. The information is for reference only and may change due to weather, tides, safety, or other operational conditions.
Permitted use
You may browse this website and contact us to inquire or book. You may not use the website for unlawful purposes, interfere with its operation, scrape content at scale, or impersonate another person.
Bookings, prices, and payments
- Bookings are arranged via WhatsApp or email.
- Availability, price, duration, meeting point, and payment methods are informed and confirmed before you contract.
- A booking is confirmed when both parties agree in writing on the date, time, price, and conditions.
- We do not store card details or payment credentials. Payments are made through the methods informed at confirmation.
Cancellations, rescheduling, and weather
- You may reschedule free of charge by notifying us via WhatsApp at least 48 hours before the activity starts.
- If you notify us with less than 48 hours’ notice or do not show up, the booking is deemed to have taken place and is not refundable, except in cases of duly evidenced force majeure.
- If we cancel due to weather, swell, unsafe conditions, or another operational cause, we will offer a free reschedule or a refund of the amount paid for the activity not performed.
- Any applicable refunds are made through the same payment method within 10 business days of approval.
- These rules do not limit the rights granted to consumers by the Chilean Consumer Protection Act.
Safety, sports risk, and sensitive data
Water and mountain activities involve inherent risks. By participating, you declare that you have disclosed any relevant physical or health conditions (for example, injuries, limitations, pregnancy, or conditions that affect your ability to take part) and that you are fit to participate. That information is treated as sensitive data with your explicit consent, solely to adapt the activity and prevent risks, in accordance with our privacy policy. If the participant is an adolescent under sixteen, consent is given by their parent, legal representative, or guardian. Arica Surf Experience is a surf school, not a healthcare provider: the physical-condition declaration is used only to adapt the activity and prevent risks.
You must follow the coach's and team's instructions. If the coach considers that conditions are not safe for you or the group, the activity may be suspended or rescheduled. We recommend taking out personal accident insurance; if insurance is included in the service, it is informed at booking.
Minors and authorization
For participants under eighteen, a parent, legal representative, or guardian must authorize in writing before the activity: participation, the physical-condition declaration, image use (where applicable), and an emergency contact. The authorization is signed in the in-person contract or sent through the channel we agree on.
For children under fourteen, consent is given by their parent, legal representative, or the person with parental responsibility. Adolescents are subject to the general rules and, for sensitive data of adolescents under sixteen, the consent of a parent or legal representative is also required. The coach may require the guardian to be present or decline participation if the authorization is not signed.
Images and audiovisual content
Photographs and videos from your session are delivered for personal use. Their publication or promotional use by Arica Surf Experience requires your express authorization and, if you are a minor, that of your parent or guardian. You may withdraw that authorization for future uses by emailing miguelmaturanacoach@gmail.com; withdrawal does not affect material already published before the request.
Equipment and transport
Equipment (board, wetsuit, and accessories) is provided in good condition for the activity. Transport is arranged subject to availability and informed at booking. Misuse, loss, or intentional damage to equipment may result in a replacement charge, informed in advance and limited to the value of the item.
Conduct during the activity
Participating under the influence of alcohol or drugs, or failing to follow safety instructions, is not permitted. The coach may suspend the participation of anyone who puts their own safety or the group's safety at risk, without a refund in that case.
Intellectual property
The text, photographs, videos, trademarks, and graphic elements on this website belong to Arica Surf Experience or are used with authorization. You may not reproduce them for commercial purposes without written permission.
Third-party links and services
This website includes links to and content from third parties, such as WhatsApp, YouTube, Instagram, and Surfline's surf report. We do not control those services or their terms; their use is governed by each provider's policies.
Liability
We make reasonable efforts to keep the website information accurate and available, but we do not guarantee that errors, interruptions, or changes will not occur. To the extent permitted by law, we are not liable for indirect damages arising from the use of the website or from decisions made based on reference information.
Nothing in these terms excludes or limits our liability for wilful misconduct or gross negligence, nor the rights granted to consumers by the Chilean Consumer Protection Act (Law 19,496) and the e-commerce rules (Law 21,398). These terms will always be interpreted so as not to deprive users of those rights.
Personal data
The processing of personal data, including sensitive data and data of minors, is described in our privacy policy. There you will find the purposes, retention periods, recipients, international transfers, and how to exercise your rights.
Changes and governing law
We may update these terms; the current version is published on this page with its version number and date. These terms are governed by Chilean law. Any dispute will be submitted to the competent courts of Chile, without prejudice to consumer rights.
